Employment law advice on
adoption leave for men and women
Both men and women are now entitled to adoption leave subject to meeting the eligibility criteria. The rules for adoption leave are similar to those of maternity leave including statutory adoption pay. One significant difference between adoption and maternity leave is that the male is entitled to take adoption leave where the couple are adopting a child jointly however only one person within the couple may take adoption leave. The other partner may receive paternity leave and paternity pay.
