Employment law advice on
grievance procedures
Grievances are raised by an employee who may have complaints or concerns relating to other members of staff, their working conditions or their terms and conditions of employment. It is vital that you handle these matters sensitively and as quickly as possible. However, you must be aware that there are statutory minimum requirements you must fulfil when dealing with these issues.
The statutory dispute resolution procedures set out minimum requirements that must be met in respect of grievances. A grievance may arise if an employee makes a complaint about the business, other members of staff or their working environment. When a grievance is raised, the procedure you use must at least meet the statutory minimum requirements. This does not prevent you from having your own policies, provided they meet the minimum requirements. It is vital that these procedures are followed to prevent an employer from falling foul of the legislation and giving rise to a claim for automatic unfair dismissal.
