Discrimination on the grounds of religion or belief is prohibited. Religion or belief is defined as any religion, religious belief, or similar philosophical belief, as well as lack of religion or belief. Collective worship, a clear belief system or a profound belief affecting an individual's way of life or view of the world are all factors which should be taken into consideration in deciding what constitutes a religion or belief.
Employers must be aware that, as the legislation refers to less favourable treatment on the grounds of religion or belief, these grounds need not relate to the religion or belief of the complainant. This means that a worker could bring a complaint of discrimination on grounds of religion or belief if they are instructed to discriminate against someone else. Less favourable treatment may also be based on a perception of the worker's religion or belief, whether or not that perception is correct.
